Airbnb and other short term rentals Update

I have gotten a couple Airbnb questions lately and so I did some research on the subject. Renting out an Airbnb or other short term rental can trigger state oversight from Health, Fire Safety, Tax, and Environmental departments. Although the situation is fluid, and may change soon from the Legislature, I have put together a little blurb that I will use for inquiries to my office. I thought I would share it with you in case you have questions come in too:

If you rent out a room or space for sleeping accommodations:

  *   Your facility is a public building and is subject to fire safety requirements. Contact Fire Safety at 802-885-8883.
  *   You will need to collect state meals and rooms tax<https://tax.vermont.gov/business-and-corp/meals-and-rooms-tax/short-term-rentals> (unless paid by a third party).
  *   If you are serving any food other than pre-packaged, you will need a food and lodging license<http://www.healthvermont.gov/health-environment/food-lodging/lodging-licensing>. Contact Gordon.Lodewyk@vermont.gov<mailto:Gordon.Lodewyk@vermont.gov> 802-296-5562.

  *   If you have only 1 or 2 units:
     *   You must post a Vermont Meals and Rooms Tax account number on any advertisement.
     *   You should complete and keep on-site a self-certification form<http://www.healthvermont.gov/sites/default/files/ENV_FL_ShortTermRentalObligations.pdf> prior to renting a unit.
     *   You must post certain information in the units (see the self-certification form).
  *   If you are effectively creating a new bedroom or an apartment, you will need a Wastewater permit as well. Contact a Licensed Designer<https://dec.vermont.gov/water/licensed-designers> (look down the page for “Finding a Designer”).
  *   As always, contact your town office to see if there are any local requirements.
  *   And, be sure to register with the Secretary of State<https://www.sec.state.vt.us/corporationsbusiness-services/business-nonprofit-services/start-a-vermont-business.aspx> if necessary.


Holiday Windham Office Hours

Please be aware that the Windham Town Office will be open this Saturday, December 22nd from 8a-12p.  We will be closed the following dates:

Monday December 24

Tuesday December 25

Wednesday December 26

Monday December 31

Tuesday January 1

Windham Elementary Informational Meeting

Informational  Meeting:

October 29, 2018 at 7 pm at the Windham Elementary School

This meeting is to inform the residents of Windham of an upcoming vote about the following articles, and the current state of affairs with regard to Act 46.

Shall the voters of Windham Town School District, if the State Board of Education votes to merge the District into West River Modified Union Education District (also sometimes referred to as West River MUUSD):

  1. Authorize the School Board to sell the Windham Elementary School building, associated land, and all associated school-related personal property, including the school bus, to the Town of Windham; and
  2. Authorize the School Board to close Windham Elementary School, effective June 30, 2019, and to provide for the elementary education of the District’s students by paying tuition, in accordance with law, to any public elementary school, or to any approved independent elementary school of the students’ parents’ choice?
